We take our clients’ financial privacy very seriously. During the course of processing your application, we accumulate non­public personal financial information from you and from other sources about your income, your assets, and your credit history in order to allow a lender to make an informed decision about granting you credit. We restrict access to non­public personal information about you to those employees and approved service providers who need to know that information to provide products and services to you. We maintain physical, electronic, and procedural safeguards that comply with federal regulations to guard your non­public personal information.

 Information Collected

We collect non­public personal information about you from the following sources:

• Information we received from you on the applications or other forms, such as your name, address, social security number, assets, and income.
• Information about your transactions with us, our affiliates, or others, such as your account balance payment history.
• Information we received from a consumer reporting agency, such as your creditworthiness and credit history

We do not sell or share customer information with third parties or outside parties who may wish to market their products to you.

You do not have to take any action or instruct us to keep your information confidential.

We may disclose the information we collect, as described above, with nonaffiliated third parties that are acting on our behalf, including:

• Companies that perform support services for us, such web service providers or companies that help us market our products and services. By sharing this information, we can better understand your financial needs and offer products to help you better reach your financial goals.

There are other situations when we may disclose to third parties the customer information we collect as permitted or required by law, including in connection with a subpoena or similar legal process, investigation, recording of deeds of trust and mortgages in public records, or the sale of a mortgage to another lender.          

We may disclose non­public personal information about you, including consumer report type information that relates solely to our transactions and experiences with you, to our affiliates. We may wish to share consumer report type information that does not relate solely to our transactions and experiences with you with our affiliates who may have products or services that are of interest to you, or who may be able to offer assistance in connection with your transaction.

Under the Fair Credit Reporting Act you may direct us not to share certain credit information with our affiliates, e.g., nonpublic personal information you provide in an application or that we obtain from nonaffiliated third parties such as credit bureaus.  If you do not want such information shared you may write to us at the address listed below.  Please provide your name, address, and other pertinent information such as an account number, if applicable.  Your request not to share credit information does not include information we are permitted to share by law, such as information related solely to our experiences or transactions with you. 

We may also disclose information about you if we are acquired by or merged with another company.  In the event of a sale of NextHome Mortgage Corp., your personally identifiable information held by us may be made available to the buyer or prospective buyers in order for them to evaluate any such purchase or to operate the acquired business.  Thus, we reserve the right to include your personally identifiable information among the assets transferred to a buyer or merger partner.  In the event of the disposition or merger of NextHome Mortgage Corp., the purchaser or surviving company will be able to use your personally identifiable information to the same extent and under the same conditions as NextHome Mortgage Corp.  We will require any such buyer or assignee to treat your personally identifiable information in accordance with this Privacy and Security Policy and disclose it only for the purposes for which it was collected and as otherwise permitted herein.

Online Technologies to Collect Information

When a visitor requests pages at any NextHome Mortgage Corp. site, our Web servers automatically recognize the browser's domain name, and IP address. Our servers do not record e-mail addresses. We collect the domain names and IP addresses in order to aggregate information on what pages users access or visit. NextHome Mortgage Corp. may send a cookie to your computer to measure site activity and to customize information to your personal tastes. This information is collected solely for statistical purposes and is not used to identify individuals.

Our users may provide their e-mail address or mailing address for the purpose of a survey or to provide additional services. Whenever the identity of a visitor is recorded, we will clearly indicate the purpose of the request before the information is requested.

You may initiate an online interactive discussion or PC to Phone communication with a Mortgage Loan Consultant to facilitate the completion of your loan application. We do not ask for any personally identifiable information to use this service; if you volunteer personally identifiable information, it will only be used to respond to your request.

When you are transmitting sensitive personal information over the Internet, such as requesting mortgage loan information, NextHome Mortgage Corp. gives you a secure connection. All of your data is encrypted with the Secure Sockets Layer (SSL) system. This creates a protected connection between you and NextHome Mortgage Corp., which safeguards your data from prying eyes.

Email is not a secure method of communication.

Keeping your information confidential and secure is as important to us as it is to you. Please be aware that any emails you send are not secure. Please do not email any confidential information such as account numbers, credit card information or social security numbers. That type of information should be provided to us by phone, fax or regular mail.

California Residents:  We will not disclose or share information about California residents without first providing you with a California Privacy Notice and honoring your choice unless such sharing or disclosure is permitted by applicable law.

Vermont Residents:  In Vermont the information we disclose under joint marketing agreements must be limited to your name, contact information, and information about our own transactions and experiences with you.  Your consent is required before we can share certain credit information about you with our affiliates.  We are permitted to share information, which is not a credit report under Vermont law without your consent, such as information related solely to our transactions and experiences with you.

The date of this Privacy and Security Policy is 1/1/2008.  We strongly encourage you to periodically review this policy and this site in order to keep apprised of our current privacy practices.  If you do not agree to any provision of this Privacy and Security Policy, or any update or modification thereto, please do not use this site.  Consumers who are NextHome Mortgage Corp. customers will be notified of updates and changes in accordance with federal law.
